Warranty & Return Policy for DIMO Online Store

Thank you for your purchase. We hope you are happy with your order; 

however, if you are not completely satisfied, you may return it to Digital Infrastructure Inc. (“us” or “we”) for a full refund or an exchange within fourteen (14) days or delivery for any reason, or within twelve (12) months of delivery for defects and other failures as defined herein. (“You,” “Purchaser” or “End User” collectively referred to herein as “you” or “your”). Please keep in mind this Warranty and Return Policy policy should be read in conjunction with the Terms of Use (“Terms”) and Privacy Policy displayed on shop.dimo.zone. Please carefully review this policy including the information below about eligible returns and our warranty. Digital Infrastructure Inc. has sole discretion to determine eligibility for its warranty as described herein. 

Digital Infrastructure Inc and its third party vendors such as AutoPi (“Third Party Provider”) (collectively referred to herein as “DIMO”) provide commercially reasonable warranty as described herein. DIMO’s warranty however is limited by your use. For instance, DIMO is not responsible or liable for any defects or errors resulting from normal wear and tear, lack of maintenance or improper use of covered products or devices, such as the DIMO Data Miner,, and as defined herein (“Product” or “covered device”). DIMO is not liable for any defects or errors related to your installation, handling and/or use of the Product including without limitation if a covered device dislodges from its position in the vehicle or in any way disrupts functioning of the vehicle including a brake pedal or leaks sensitive personally identifiable information through its connectivity as a web product.

The Product is purchased, and not leased. Upon payment by you for the Product and confirmation to you of shipment, you will acquire ownership of and title to the hardware components of the Product, and you will be licensed to access and use all software installed in the covered device (and any updates thereto), on a limited, non-exclusive, revocable, non-sublicensable, non-transferable basis, solely for the purposes of using the Product.  Accordingly, Purchaser shall not (i) use the Product in any way that is: (a) fraudulent or misleading, (b) infringe on any third party’s intellectual property rights or rights of publicity or privacy, (c) is defamatory, trade libelous, threatening, or harassing, (d) contains any viruses or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept, or expropriate any system or data, or (e) otherwise violate any applicable law; (ii) modify, decompile, reverse engineer, disassemble or otherwise attempt to determine or alter the source code of the Software; (iii) sublicense or allow any other person to use the Product, except as permitted under the Terms and with full accountability for any such use; or (iv) use the Product in a manner that interferes with the use of the Product by DIMO or its other customers; or copy any ideas, features, functions or graphics of the Software.

 

WARRANTY

Digital Infrastructure Inc. warrants that the Product shall materially comply with the obligations set forth in the Terms of Service. Purchaser’s sole and exclusive remedy and Digital Infrastructure Inc.’s sole and exclusive liability for breach of the foregoing warranty shall be for DIMO to repair or replace the defective element of the Product or, if repair or replacement cannot be provided within a reasonable time or refund any pre­paid fees therefor. This warranty is limited to the Purchaser as it is not transferable.

As described herein, DIMO honors a twelve (12) month warranty on the DIMO Data Miner from the point of delivery, in case of defect when there is no software fix available. For this policy, software fix is defined as any change to the existing software and/or hardware configuration by a software update or an over-the-air (OTA) update to restore the functions as specified by the DIMO Data Miner.  

EXCEPT FOR THE WARRANTIES SET FORTH HEREIN, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE PRODUCT IS PROVIDED ON AN “AS-IS” BASIS, AND DIGITAL INFRASTRUCTURE INC. DISCLAIMS, AND PURCHASER WAIVES, ANY AND ALL OTHER WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, THAT THE PRODUCT WILL PERFORM PROPERLY OR THAT USE OF THE PRODUCT WILL BE UNINTERRUPTED OR ERROR-FREE. PURCHASER ACKNOWLEDGES THAT THERE ARE RISKS ASSOCIATED WITH UTILIZING AN INTERNET-BASED SOFTWARE, INCLUDING WITHOUT LIMITATION, THE FAILURE OF HARDWARE, SOFTWARE AND INTERNET OR OTHER NETWORK CONNECTIONS AND THAT DIGITAL INFRASTRUCTURE INC. SHALL NOT BE RESPONSIBLE FOR ANY FAILURES, ERRORS, DISTORTIONS OR DELAYS PURCHASER MAY EXPERIENCE, REGARDLESS OF THE CAUSE. PURCHASER ACKNOWLEDGES THAT INFORMATION YOU STORE OR TRANSFER MAY BECOME IRRETRIEVABLY LOST OR CORRUPTED OR TEMPORARILY UNAVAILABLE DUE TO A VARIETY OF CAUSES, INCLUDING SOFTWARE FAILURES, PROTOCOL CHANGES BY THIRD PARTY PROVIDERS, INTERNET OUTAGES, FORCE MAJEURE EVENT OR OTHER DISASTERS INCLUDING THIRD PARTY ATTACKS, SCHEDULED OR UNSCHEDULED MAINTENANCE OR OTHER CAUSES EITHER WITHIN OR OUTSIDE DIGITAL INFRASTRUCTURE INC.’S CONTROL. PURCHASER IS SOLELY RESPONSIBLE FOR BACKING UP AND MAINTAINING DUPLICATE COPIES OF ANY INFORMATION PURCHASER STORES OR TRANSFERS. 

 

DEFECTS LIABILITY & NOTIFICATION

Our supplier, AutoPi, is obliged to deliver the Product free from any defects when you purchase directly from us. This warranty does not apply to Products purchased from third parties. In case a defect should occur in a Product purchased directly from DIMO, whereby the Product is no longer able to perform its function safely and effectively due to no fault of the Purchaser or End User, and which cannot be remedied by a remote software update, within a period of 12 months calculated from the delivery of the Product (hereinafter referred to as the “Defects Notification Period”), Digital Infrastructure Inc. relies on AutoPi a to timely repair or replace the Product with a device that is substantially similar and meets the intended functional specifications of the original Product. To the extent that such a repair or replacement is to take place as mentioned above, this shall only take place in total once every quarter for the repairs and replacements etc. that have been demanded in the quarter in question. DIMO is not liable for any defects occurring after the expiry of the Defects Notification Period.

 

LIMITATION OF LIABILITY

In addition to the force majeure, limitation of liability and other related sections in the Terms of Use, DIMO reminds you of its limited liability for your approved use of the Product as it relates to Third Party Providers. The relationship between you and any Third Party Provider is strictly between you and such Third Party Provider, and Digital Infrastructure Inc. is not obligated to intervene in any dispute arising between you and a Third Party Provider.

We do not provide any warranties or make representations to you with respect to Third Party Services. You acknowledge that Digital Infrastructure Inc. has no control over Third Party Services and will not be responsible or liable to you or anyone else for such Third Party Services. The availability of Third Party Services on our website or the integration or enabling of such Third Party Services with the Services does not constitute or imply an endorsement, authorization, sponsorship, or affiliation by or with Digital Infrastructure Inc. Digital Infrastructure Inc. does not guarantee the availability of Third Party Services and you acknowledge that may disable access to any Third Party Services at any time in its sole discretion and without notice to you. Digital Infrastructure Inc.is not responsible or liable to anyone for discontinuation or suspension of access to, or disablement of, any Third Party Service. Under no circumstances will DIMO be liable for any direct, indirect, incidental, special, consequential, punitive, extraordinary, exemplary or other damages whatsoever, that result from any Third Party Services or your contractual relationship with any Third Party Provider. The foregoing limitations will apply to the fullest extent permitted by applicable law. You agree to indemnify and hold us and (as applicable) our parent, subsidiaries, affiliates, partners, officers, directors, agents, employees, and suppliers harmless from any claim or demand, including reasonable attorneys’ fees, arising out of your use of a Third Party Service or your relationship with a Third Party Provider.

If you install or enable a Third Party Service for use with the Product, you grant us permission to allow the applicable Third Party Provider to access your data and other materials and to take any other actions as required for the interoperation of the Third Party Service, and any exchange of data or other materials or other interaction between you and the Third Party Provider is solely between you and such Third Party Provider. DIMO is not responsible for any disclosure, modification or deletion of your data or other materials, or for any corresponding losses or damages you may suffer, as a result of access by a Third Party Service or a Third Party Provider to your data or other materials. Google Maps is a Third Party Service that is used within the Product. Your use of the Product is subject to your acceptance of the Google Maps and Earth Enterprise Universal Acceptable Use Policy, Google Maps and Google Earth Additional Terms of Service and Google Privacy Policy as it may be amended by Google from time to time.

 

RETURNS

All returns must be postmarked within fourteen (14) days of the Product delivery date. All returned items must be in new and unused condition, with all original labels attached. Return orders may be canceled at any point prior to shipping.

Returns and refunds are not available for Products not under warranty including the following:

  1. Devices that are not purchased directly from shop.dimo.zone
  1. Covered devices that are not in the possession of the original Purchaser and/or are not supported by a valid proof of purchase 
  1. Covered devices that have defects and damages caused by 
    • tampering including without limitation taking the device apart and modifying it in any way
    • misuse including without limitation using the device outside of its original design
    • abuse including without limitation intentionally subjecting the device unreasonably beyond normal wear and tear
    • improper installation including without limitation connecting the device to your vehicle that is outside of our recommended guidelines, and
    • normal wear and tear
  1. Devices paired, by connecting to the mobile app, are considered used and are not eligible as covered devices in unused condition. 

 

RETURN PROCESS

To return an item, please email customer service at store.support@dimo.zone to obtain a Return Merchandise Authorization (RMA) number. After receiving a RMA number, place the item securely in its original packaging and include your proof of purchase/and the return form provided, and mail your return the following address:

Please note, you will be responsible for return shipping charges. We strongly recommend that you use a trackable method to mail your return. Return shipping charges may be paid or reimbursed by us for defective hardware or incorrect.

Please also note a repaired or replaced Product is covered until the expiration of the warranty: twelve (12) months after the original date of purchase.

 

REFUNDS

After receiving your return and inspecting the condition of your item, we will process your return or exchange. Please allow at least two (2) business days to process returns days from the receipt of your item to process your return or exchange. Refunds may take 1-2 billing cycles to appear on your credit card statement, depending on your credit card company. We will notify you by email when your return has been processed.
